Weak Defense Might Yield Life Sentence for Local Man Who Claims Innocence

Makeitha ChristonMakeitha Christon’s life hangs in the balance while he awaits a sentence hearing, where it is expected that the 25-year-old resident of Los Angeles will be given a life sentence for a crime that he may not have committed.

On the night of September 1, 2005, an armed man attempted a robbery and shot three men, killing one of them, near Western and Century. The shooter was able to flee the scene. An eyewitness pointed out to the police a man believed to be the shooter. There was also a video of this same man near the crime scene at the time of the murder. A wanted sign with this man’s picture and name was posted, but he was never apprehended.

According to Christon’s aunt, Yvette Cunningham, Christon’s name did not surface until a $50,000 reward was offered for the arrest and conviction of the shooter. Cunningham said that at that time Christon’s ex-girlfriend stepped forward and claimed that Christon told her that he was involved in the shooting.

Christon’s name and photo was then put along side the other suspected shooter’s photo on the wanted sign. On November 21, 2006, Christon was arrested for murder, attempted murder, and armed robbery.

Cunningham came to her nephew’s aid and hired attorney Joel Isaacson, who argued in preliminary hearings that there were discrepancies and inconsistencies in the prosecutions witness’ testimony. Isaacson argued that the district attorney failed to prove the allegations and that the case should be dismissed due to lack of evidence. There was no murder weapon, eyewitness, or DNA found to link Christon to the crime.

The case still went to trial. Cunningham hired a new attorney, which she believes is the worst mistake that she made. She contends that the new attorney, Barry O. Bernstein, mishandled the case.

“Barry Bernstein, without a doubt, failed miserably to properly represent my nephew,” Cunningham said. “Mr. Bernstein only called two witnesses on the Makeitha’s behalf, which were youngsters from the neighborhood. He did not organize a defense witness list of people that could have testified as to the good mannerisms or accomplishments coupled with first hand knowledge that Makeitha had not committed illegal acts.”

Toward the end of the trial Cunningham overheard two of the jurors talking openly about this case. She brought that to Bernstein’s attention, who was supposed to report that to the judge. That could have caused a mistrial. But Bernstein failed to notify the judge and the case carried on.

On April 30 of this year, Christon was found guilty on nine counts of murder, attempted murder, and armed robbery.

At that point Bernstein tried to get Christon a new trial because the jurors had openly spoken about the case, but the judge ruled that Bernstein is a seasoned attorney and the courts should not be held accountable for his oversight. That oversight is very costly to Christon, who is awaiting sentencing.

Cunningham has sent a complaint to the State Bar of California Audit and Review office, hoping that they will find that Bernstein was negligent. Cunningham is hoping that will allow Christon to receive a new trial.

Cunningham said that Bernstein only visited Christon once before the trial and once during the trial. She also said that Bernstein missed a number of hearings for the case, sending his assistants instead. The State Bar told Cunningham that since she filed a complaint against Bernstein he has changed his name to Bob Bernstein.

When contacted by the Sentinel Bernstein’s assistant said that he had no comment.

Christon’s life may never be the same. He did not have a juvenile record, and the only incident that he had ever been a part of was a misdemeanor domestic charge over an argument with a girlfriend while he was in the Navy.

Christon has a two year old daughter that he has not seen since she was seven weeks old.

It is unclear who was the murderer, but it does appear that justice has not been done.

Christon has a new attorney, and will have to wait for an appeal, which is a very lengthy process.

“It is very unfortunate that a very small amount of circumstantial evidence can cause a person to be convicted,” said Wayne Higgins, Christon’s attorney. “A jury has made a decision, but it is a matter that should warrant a further review with an appeal.”

Higgins said that Christon is being very patient, understands the appeal process, and hopes to come out victorious.

This is incrediable, Christon impeccable past is not the actions of a murderous gang banger, Makeitha has a trouble and crime free historoy. There are too many good young african american men trying to live a productive constructive life and they are being railroaded by an over zealous detective, and an hopeless attorney in addition the prosecution has a picture of the right person that committed this crime this is absurd.

We need to come together as a black race and work on getting a non profit organazation of denfense attorney to help save our young black males from this modern day slavery. This happens to more young black men than most people can even began to image. People only beleive this sort of event can happen, when it hits home. We really need to rally together to try and save our young future. If we don't start trying to save our children we will be instinct.

If the police has a picture of the actual shooter and there are witness who pointed out the actual shooter which is not this young man why pray-tell is he being charged less known convicted. LAPD is known for rush to judgement rather than persuing the real criminal, this is a very sad and dispicipal story

It is an extreme miscarrage of justice when you have information that is not allowed to give a young man a fighting chance. But a system that is willing to believe a woman scorned, and willing to put an innocent young father in Prison for Who knows how long When even for one day when he is innocent is too long. I have time and time again seen black men spend years to the sum of 20+ for crimes they didnt commit only to be found innocent and have lost a precious amount of their life behind a LIE. Listen people are quick to say dont play the race card. But when have you ever known of a white or other ethnicity for that matter to sit in jail for 20+ years innocent of the crime they've been convicted of( I cant think of one) so whats wrong with that picture? Yeah this is still America people. There are many corrupt police, and some are associated with this case but nothing happens to them. They should replace the innocent with those guys. But those involved guilty of whatever crime against this young need to get it together because there is a great surge of Prayers "In Jesus' name" going up for this young man and for justice. I have every confidence in the God I serve. He has never let me down. Never. So to Makeitha and his family keep your hand in Gods, keep looking up because your redemption draws nigh! It's gonna be ok.

What is apparently wrong with this incident and many others is the Dysfunctional jury system. It must be reformed. There are other cases similar to this where innocent people are convicted. Ditto to Ms. Cunningham for taking this on.

I am so tired of reading stories of our young men and women being convicted because of incompetent attorneys. Are there any more Johnnie Cochrans out there?

I know for a fact that the police know that Makeitha wasn't even there when the robbery/shooting happened. They are going after him simply because they do not want to lose a case. I didn't believe that this type of thing happened today but I was proven wrong.  
 
If there is anyone out there that can help Makeitha please contact us. This man risked his life for his country and this is the thanks he gets....this is so sad and shocking.

Here they go again with this modern day slavery. This young man, my nephew VOLUNTEERED to serve in the Navy for this country. They cannot find any evidence against him. Only evidence they have is hear say no proof. No weapons. But he's found guilty. How is that possible? Just another black man taken. It's Not Fair!!!!!

This is awful, this sounds like a very poor Judicial system starting with that pitiful LAPD department, if there are witnesses of other suspects why isn’t that person on trial. The Police the DA the Judge all went by some so-called accounts of a jilted ex-girlfriend, that’s terrible. Then California allows a shady Attorney to practice law so yet another innocent young man can being blamed just to close the case. My prayers to the entire Christon family as the reader before me I agree your family should continue to pray and lean on faith, someone is going to find and punish all the pathetic players in this lynching.

How can we let society send another black man to prison without no proof that he committed the crime? How can a jury find this man guity with(NO WEAPON OR WITNESS)? How can we believe an jelous ex-girlfriend that didn't come forward until a year later when they broke up and a reward was posted? Please keep our family in your prayer that my nephew get a fair trail and justice be serve.

It's really sad of what our society has come to. And so call ex-girlfriend can lie on a Makeitha just to get reward money and a man can go the prison for life. A man who went to war to defend our country can even get a decent attorney to defend him. Makeitha you are in my prayers.

I am a female and I have many female friends and I know how we act. We are born emotionally attached to the male gender and when things don't go our way we become evil. They convicted this man based on the words of an angry ex girlfriend, after she seen the $50,000 reward, one year later. This can't be happening! How can LAPD destroy an innocent man's life based on hear say? There is no evidence against Makeitha. No weapon, no fingerprints, no valid witnesses, no gun shot residue, no DNA samples (there are fingerprints left on bullets, I'm sure the coroner collected). NO EVIDENCE! We spend billions of taxpayers money on up to date technology to be able to investigate horrendous crimes. So what happened here? It's not fair and justice was not served. Why does the system keep taking our good black men away? He has done nothing wrong, so why is he being punished? He went to fight for our country, does that even matter? At least give him a fair trial!

I am in total agreement as I continue to fight for my nephew who has been in chains with this corrupt system for ten years now as we continue to fight for his release for a murder that he is completely innocent of. My nephew has missed the life of his now 9yr. old son, many deaths of immediate family and has MS that is highly aggressive. We must begin to look into what we can do as a race to stop this vicious attack of our young black men. I pray that change of a new administration will release needed serious dollars that organizations new and old will be able to tap into to stop this dreaded violent and abusive attack upon our black race.

This is not a rare situation it is just being brought to the public eye, once again this time it's Makeitha Christon, but writing comments is good but what we as people of color must do is start attending meetings that are held in most neighborhoods informing you of what is going on and talking to those policemen that are patrolling our neighborhoods instead of just complaining let your voices be heard. The attorney situation is just as bad - many times we pay thousands of dollars for a defense and because the defendent is black the defense is not rigorus. Then you have the almighty judges that does not care for justice many times they are just trying to clear their calendars. 
So, to the family of Makeitha Christon just keep on putting this story out there and take it to the media and demand solid evidence which includes DNA AND everything else, If the money is there have the ex-girlfriend take a lie detector test although not admissable in court it may also be accepted as a reason for a new trial. Get all the transcripts and let other legal minded persons review it and see where the attorney faulted. BE BLESSED IN YOUR ENDEAVORS. BUT DO NOT STOP WITH YOUR FAMILY MEMBER GET WITH OTHER FAMILIES THAT ARE IN THE SAME OR SIMILAR SITUATIONS.

What facts did the ex-girlfriend have to support her theory? 
Will someone please help me to understand how this young 
man was convicted on hearsay and speculation, and did she 
received the reward? What made the ex's mouth a prayer book 
Is there anything we can do as a people to be of assistance to this 
young man. Has a fund been set up?

We have a similar problem with this attorney and there's other 4 or 5 people that I know of who have had similar problems with this attorney, I hired him to defend my brother and the trial only lasted a day and a half, he didn't called any witnesses and we gave him a lot of information to put a good defense but he didn't do anything, they say jails are filled but now I understand what's going on, the system is really bad needs to be changed. The real criminals are attorneys like this they get paid thousands of dlls and they don't do the job, I know how you guys feel, if I can be of any help please let me know, maybe we can do something.

Another case of blind justice, the evidence in this case is circumstantial. Here we have a young black man who served in the military fighting for his country and now he on trail fighting for his life, what a pity. It is obviously a case of incompetent people starting with the Police department, the Attorney and the jurors. How can this be? What is wrong with our Judicial system when it comes to our black men. I am praying for Makeitha and his family that he will be released and resume his life.

I think as a black man I'am terrified to step out of my doors each day because of messed up situations as this one that arises in our community each day because of the color of my skin. I pray and hope that justice is served properly so that Makeitha gets the proper decision. Life for something you didnt do is very devastating in any situation.
