The body of a 98 year old woman sat decomposing at Boyd’s Funeral Home for over 30 days as the family tried to gain control of the remains and the estate of the deceased from a court appointed conservator.

 In a ruling harking back to the Jim Crow Era, Judge David Cowan gave a court appointed conservator control of the body rather than the family.

The family alleges that the conservator took all the assets of the estate and used the court process to hide the funeral home’s actions. The conservator never knew the deceased when she was alive and is not familiar with African-American funeral traditions.

Boyd refused a request by the family to allow the remains to be moved to the family’s funeral home of choice.  In a hearing on January 21, Judge David Cowan refused to accept and consider papers filed by the family.

In an effort to seek justice for the family, Attorney Dermot Givens has filed a probate case on behalf of the family and has filed complaints against Boyd Funeral Home, Judge Cowan, and the court appointed Conservator.
