The California State Assembly today approved AB 441 by Assistant Speaker pro Tempore Isadore Hall, III (D- Compton), which would expand upon the state's '100 foot rule' to prohibit an individual from soliciting a donation or engaging in commercial activity within 100 feet of a polling place on Election Day or at an election official's office.  

The measure was approved by a vote of 75 to 2.

While explicit electioneering is prohibited within 100 feet of a polling place on Election Day or at an election official's office, nothing in current law prohibits an individual or group from seeking to influence or intimidate voters using a number of passive means.  

AB 441 would provide important protections for voters at a polling place and is a reasonable step to ensure that voters can cast their ballot without undue influence or intimidation.

"Voters should be free of any outside influence or intimidation at a polling place," said Assemblymember Hall. "I am proud to have received strong bi-partisan support of AB 441 and believe this measure is an important step to further strengthen California's commitment to a free and fair election process."  

AB 441 now moves to the State Senate for further consideration
