Board of Equalization Unveils New Top 500 Tax Debtors
New Tools Help Ensure Compliance and Close Tax Gap
Sacramento – Individuals and businesses appearing on the Top 500 Delinquent Taxpayer list face new penalties beginning July 1, according to the California Board of Equalization (BOE). They could lose their state-issued licenses, including driver’s licenses and occupational or professional licenses. Under the new law, state agencies will also be prohibited from entering into contracts with the Top 500.
The penalties are part of a law aimed at providing incentives for tax delinquents to pay their debts. The BOE is committed to collecting taxes owed to the state to provide revenues needed for essential public services. Those on the updated Top 500 list owe $570.8 million.
"When taxpayers choose to ignore their tax debts, they leave the Board no alternative but to step up its enforcement efforts," said Chairman Jerome E. Horton, author of the legislation that created the original list. “Their failure to play by the rules places an unfair burden on all Californians and robs the state of funding for critical services like education and public safety.”
The total amount collected by the BOE since the first list was posted in 2007 is $5.7 million. Taxpayers who are scheduled to be listed are given a 30-day notice so they have a chance to take care of their bills. Tax liabilities under appeal, in litigation, or in bankruptcy proceedings are not included on the list.
The Franchise Tax Board (FTB) also has a Top 500 list and together with the BOE have collected more than $135 million since the program began.
The original Top 250 delinquency list was a result of a state law (AB 1418) authored by BOE Chairman Jerome Horton when he was a member of the California State Assembly in 2006. The Top 250 list was expanded to 500 in 2012 under AB 1424.
BOE’s list of the state’s Top 500 sales and use tax delinquencies is updated quarterly at boe.ca.gov. Taxpayers on the Top 500 list may contact the BOE to resolve their accounts and make payment agreements. Taxpayers who need assistance may contact the BOE at 916-445-5167. The FTB Top 500 list published biannually is on FTB’s website at ftb.ca.gov.

Elected in 2010, Chairman Jerome E. Horton is the Fourth District Member of the California State Board of Equalization, representing more than 8.5 million residents in Los Angeles County. He is also the Board of Equalization Legislative Committee chairman. He is the first to serve on the Board of Equalization with over 21 years of experience at the BOE. Horton previously served as an Assembly Member of the California State Assembly from 2000-2006.
